1. Acceptance of Terms

By downloading, installing, or using the MusoMap mobile application ("the App") or visiting our website at musomap.co.za ("the Website"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the App or Website.

These Terms constitute a binding agreement between you and MusoMap (Pty) Ltd ("MusoMap", "we", "us", or "our"), a company incorporated in South Africa.

2. Description of the Service

MusoMap is a live event discovery platform that allows users to:

• Discover live music events, quiz nights, and karaoke nights near them
• Browse registered artist profiles and venue listings
• View event details, get directions, and share events
• Favourite artists and venues (when signed in)

MusoMap is a discovery service only. We do not sell tickets, process payments for event entry, or facilitate bookings between users and artists or venues. We are not responsible for any aspect of the events listed on the platform.

3. User Accounts

3.1 General Users (Music Fans)

You may browse MusoMap without creating an account. To access features such as favouriting artists or venues, you must sign in using a Google or Apple account. You are responsible for maintaining the confidentiality of your sign-in credentials.

3.2 Artist Accounts

Artists may register for an account using an email address and password. All artist registrations are subject to approval by MusoMap. We reserve the right to approve or reject any artist registration at our sole discretion. Once approved, artists may create and manage up to five (5) performer profiles and post music gigs.

3.3 Venue Accounts

Venues are listed and managed by MusoMap. Venue accounts are created by MusoMap on behalf of venue operators following a registration request and approval process. Venue operators who have been granted account access may post quiz nights and karaoke events directly from their venue dashboard.

4. Content and Listings

4.1 Artist Content

Artists are solely responsible for the accuracy, completeness, and legality of all content they post, including but not limited to: stage name, biography, genres, event details, dates, times, entrance fees, and venue information. MusoMap accepts no liability for inaccurate event listings.

4.2 Venue Content

Venue operators are solely responsible for the accuracy of quiz night and karaoke event listings they create, including dates, times, and descriptions.

4.3 Content Standards

All content submitted to MusoMap must:

• Be accurate and not misleading
• Not infringe any third-party intellectual property rights
• Not be offensive, defamatory, or unlawful
• Not advertise competing services or platforms

MusoMap reserves the right to remove any content that violates these standards, and to suspend or terminate accounts responsible for such content, without notice.

5. Intellectual Property

The MusoMap name, logo, application design, website, and all associated content created by MusoMap are the exclusive intellectual property of MusoMap (Pty) Ltd. You may not reproduce, distribute, modify, or create derivative works of any MusoMap content without prior written consent.

By submitting content to MusoMap (such as profile photos, bios, or event descriptions), you grant MusoMap a non-exclusive, royalty-free licence to display, distribute, and promote that content within the MusoMap platform and for marketing purposes.

6. QR Codes and Deep Links

Artists may generate QR codes that deep-link to their profiles within the App. If the App is not installed on a scanning user's device, they will be directed to the appropriate app store. MusoMap does not guarantee the availability of the App in all regions or app stores.

7. Third-Party Services

The App integrates with the following third-party services:

• Google Maps: For venue location display and directions
• Google Sign-In / Apple Sign-In: For general user authentication
• Device share functionality: For sharing events via installed apps

Use of these third-party services is subject to their respective terms and privacy policies. MusoMap is not responsible for the practices of these third parties.

8. Disclaimers

The MusoMap platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law:

• MusoMap does not warrant that event listings are accurate, up to date, or complete
• MusoMap does not warrant that the App will be available at all times or free from errors
• MusoMap is not responsible for any loss or inconvenience arising from reliance on information displayed in the App
• MusoMap does not endorse any artist, venue, or event listed on the platform

9. Limitation of Liability

To the maximum extent permitted by South African law, MusoMap and its directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App or Website, including but not limited to: loss of profit, loss of data, personal injury, or property damage.

10. Privacy

Your use of MusoMap is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using MusoMap, you consent to the collection and use of your information as described in the Privacy Policy.

11. Venue Payments and Refunds

Certain premium features of the venue dashboard (including enhanced analytics) may be subject to a subscription fee. All payments and refunds for venue accounts are governed by our Refund Policy.

12. Modifications to the Service

MusoMap reserves the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App or Website after any changes constitutes your acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of MusoMap shall be subject to the exclusive jurisdiction of the courts of South Africa.

These Terms also comply with the requirements of the Electronic Communications and Transactions Act 25 of 2002 (South Africa).
